外贸合同风险：将于2023年9月1日起生效的新版fosfa第33号合同（液袋/集装箱合同）的相关修订 -pg电子试玩网站免费

按：gafta/fosfa等国际商品贸易组织制定并颁布的系列标准合同，在相关领域的国际贸易中得到广泛适用，一般认为，其在特定交易中的覆盖面达到80-85%左右。这些合同的形成和发展源自整个行业近两个世纪以来在全球范围的贸易实践，随着形势的发展、实践的需要，这些合同不断推陈出新。对参与贸易的特定企业而言，标准合同是行为和义务的规范，对整个行业而言，标准合同是行业性的国际贸易惯例。这些不断发展完善的标准合同从各自的视角见证了国际贸易的时代发展，凝聚着近代以来的全球贸易商对业务实践的探索与思考，是全球贸易界共同积累并珍视的思想财富。

fosfa 33号合同是一个针对采用液袋或通用集装箱运输方式的标准合同（contract for flexitanks/general purpose freight containers）。

笔者得悉，近期，有关方面对33号合同第3条做了修订，新旧条款的内容对比如下：

修订前的33号合同第3条：

3. containers:

sellers are responsible for ensuring that the goods are shipped in flexitank/s complying with bsi pas 1008:2014 or successor and general purpose freight container/s of a suitable type and condition.

operations relating to flexitanks and flexitank systems should be in accordance with the container owners association’s code of practice for flexitanks, version 3, dated 1 september 2011 or successor codes of practice.

flexitank operations, including heating, to follow the manufacturer's instructions/operating procedures.

修订后的33号合同第3条：

3. containers:

sellers are responsible for ensuring that the goods are shipped in flexitank/s complying with the version of bsi pas 1008 valid at contract date and general-purpose freight container/s of a suitable type and condition.

operations relating to flexitanks and flexitank systems should be in accordance with the container owners association’s code of practice for flexitanks valid at contract date.

flexitank operations, including heating, to follow the manufacturer's instructions/operating procedures.

上述修订的原因，是因为相关集装箱规则的推陈出新。至于修订前后的条款内容的含义，则是不言自明的。

修订后的新版33号合同将于2023年9月1日起生效。
